By accessing or using DigitalKneeboardSimulator.com (“DKS,” “the Service”), users agree to these Terms.

Use of Service

The Service may be used only for lawful purposes. Users may not:

• Violate applicable law
• Upload malicious, illegal, infringing, or harmful content
• Attempt to disrupt, abuse, or compromise the Service
• Access data or accounts not belonging to them
• Use the Service in a manner that interferes with other users or infrastructure

Your Content

You keep ownership of everything you upload or create on the Service. These Terms do not transfer any ownership of your content to us.

To run the Service we need your permission to handle your files. By uploading or creating content, you grant the operator a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, back up, cache, reproduce, transmit, reformat, convert, resize, excerpt, adapt, create derivative works from, publicly display, and distribute that content — for the purposes of operating, securing, supporting, improving, and promoting the Service, and of delivering your content to the people you have chosen to share it with.

In practice, that permission covers everyday things like: storing your files with our hosting and content-delivery providers; generating page images, thumbnails, and previews from a document; rendering your data into kneeboards, maps, cartridges, and exports; compressing and converting files between formats; keeping backups and redundant copies; and showing your content to the squadron members or other users you have shared it with.

This license lasts as long as your content is on the Service, and continues afterwards only to the limited extent needed for backups and for copies already distributed as described below.

Sharing and Publishing

Some features let you share content with your squadron or publish it to other users — for example publishing a kneeboard, a public map, a plate submission, or a training course and its materials. When you use one of those features, you also grant other users of the Service a license to view, download, and use that content within the Service, on whatever terms you selected when you shared or published it.

You control your sharing settings and are responsible for what you publish. Copies that other users have already downloaded or imported may continue to exist after you unpublish or delete the original, and we cannot recall them.

Private uploads are intended to remain non-public, but confidentiality and security cannot be guaranteed.

Rights in What You Upload

You are responsible for making sure you have the rights to upload, share, and publish everything you submit, including any third-party material it contains, and for granting the licenses described above. Please do not upload material you are not permitted to distribute.

Deleting Content

Removing content from the Service removes it from the interface. Copies may remain in backups, logs, and caches for a limited period as part of normal operation, and copies already distributed to other users are not recalled.

Feedback

If you send us suggestions, ideas, or feedback about the Service, we may use them without restriction and without any obligation to you.

Content Removal / Moderation

The operator may remove, disable, or restrict access to any content at any time, with or without notice, for any reason.

Account Termination

The operator may suspend, restrict, or terminate any account or access to the Service at any time, with or without notice, and without liability.

Availability / Data Loss

The Service is not a backup or archival platform.

The Service may be modified, interrupted, suspended, or discontinued at any time without notice.

No uptime, availability, backup, or data preservation guarantees are provided. Users are solely responsible for maintaining independent backups of any important data.

Aviation / Operational Use Disclaimer

The Service is not intended for mission-critical, safety-critical, aviation-critical, or operationally critical use. Users assume all risk arising from reliance on the Service or its output.

Disclaimer of Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR OF DIGITALKNEEBOARDSIMULATOR.COM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, CONTENT, PROFITS, GOODWILL, OR SERVICE AVAILABILITY.

IN NO EVENT SHALL TOTAL LIABILITY EXCEED $100 USD.

Indemnification

Users agree to indemnify and hold harmless the operator of DigitalKneeboardSimulator.com from claims, damages, liabilities, and expenses arising from their use of the Service, uploaded content, or violation of these Terms.

Governing Law

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict of law principles.

Changes

These Terms may be updated from time to time. Continued use of the Service constitutes acceptance of the updated Terms.
